Property Survey (The Boundary Survey)
Do you know where your lot lines are? Are you waiting for your neighbor to get a property survey? Did you believe the seller who told you it was the fence, or the post, or the tree, or the power pole? All of these might be indicators, but most often mean absolutely nothing when it comes to the actual location of your lot.
Does your title commitment schedule B-II say anything about discrepancies, conflicts, shortages, or encroachments? Your title insurance provides NO guarantee to the location of your parcel, unless, of course, you had an ALTA survey performed in conjunction with the commitment.
It's not too late. A simple boundary survey, performed, mapped, and put on record, in your name, provides you the best legal evidence of the size and location of your land.
If there is any evidence of an encroachment or trespass by your neighbor, or by you, the laws of adverse possession apply to the actual ownership of the land, regardless of the legal location of the line.
Occupying your land according to the legal location of the lot line is so important in order to prevent disputes. If you already have a dispute, contacting a highly qualified surveyor is a good first step.
